we saw senators john mccain, lindsey graham, put out a statement on friday afternoon saying this should not have happened at all. if you are going support comprehensive immigration reform, it would be to make sure that people come out of the shadows, that the country knows who is in this country and who is not. they were really defensive, trying to come out for this type of thing. it is important to note in this debate that these two brothers came to the united states for sure thatt i am not is applicable to the big contours' of the immigration reform bill that is trying to give a pathway to citizenship to people who are illegal in this country, not those who came in under asylum. host: the fbi is under some criticism because apparently they had looked into the older brothers trip to russia. six months. for they don't know who we had contact with and the fbi basically said he was not a threat. and of course we know what happened last monday. guest: there will be a tremendous amount of reporting over the next several days about what the fbi knew and did not know. in some type of instance

john mccain, lindsey graham, graham saying at least consider suspect as enemy combatant for intelligence gathering purposes. what is the white house saying about that decision? >> reporter: well, you heard the president urge restraint in terms of passing judgment. i can tell you that representative peter king also joining in the chorus that you just mentioned. so, i think the white house being very cautious in terms of moving forward on this front, urging sort of restraint from the american people in terms of judging and prejudging how this should be handled at this very moment, chris. >> all right, kristen welker, thanks very much. >>> we'll continue to delve in to many of the issues, where this investigation is going, what we know now and what investigators need to know. for 15 years. that's 3 moves, 5 jobs, 2 newborns. it's no wonder i'm getting gray. but kate -- still looks like...kate. with nice'n easy, all they see is you -- in one simple step, nice'n easy with colorblend technology, gives expert highlights and lowlights. for color that's perfectly true to you. i don't know all her

i don't want to speak for lindsey graham or kelly ayotte, but i think what they would say is we would like absolutely to have the possibility. if there is ticking time bomb let's find out about it. miranda was put into place so you don't have coercion and false confessions under pressure. you don't want to have that but you can prevent that in earth ways too. you can videotape the entire proceeding but you also want to have a more thorough investigation, again because you want to know the methods that are being used. if one of the brothers went to chechnya as we think he did, and was trained by whom or what cells was he told to go back and do this. anytime of your own choosing? will you get a phone call to tell you to do it? was he in touch with other cells may not do something immediately but in three months and at that time people will be killed? i'm absolutely for constitutional questions but it was justice robert jackson who said the constitution is not a suicide pact. to choose not to know is wrong. i want to also raise one other thing and i think senator graham was quite right i

graham, john mccain, kelly ayotte, congressman peter king, all of whom have said this suspect based on his actions clearly is a good candidate for enemy combatant status. we do not want this suspect to remain silent. talk about that in terms of what prosecutors are doing right now. is that the path down which prosecutors and any investigators are going right now? >> well, it's unclear whether or not they're going down that path to identify and designate him as an enemy combatant but they should at least go down the path to determine whether or not that is the designation they should make for this particular person. then they should do it based on our national security, national interest to determine whether or not identifying him as an enemy combatant will actually enhance our national security and national interest. >> what about the charges? what do you expect them to be against dzhokhar. >> well, if he's not designated as an enemy combat eant he wille charged federally. the first decision has to be if he's designated enemy combatant. if they decline, they'd be looking at charges

what we are trying to achieve with lindsey graham and kelly, that is the most important thing. our priority should be not to punish these perpetrators, not to prosecute them, not to rehabilitate them. our main purpose should be that we have somebody in custody that may know of other terrorist plots and terrorist cells that has information that could save lives. can they get information from them? tell them that he has the right to remain silent and we are going to remain ignorant of the information that he has, even if that means that other people will be killed and a terrorist act in the future. it is a mistaken decision to say that we will remain ignorant. aside from all of the prosecution and issues. we are remaining ignorant right choice. >> officials say the boston bombing suspects are apparently motivated by religion. no terrorist group ties. -- brother's mastermind masterminded the attack. they worked independently. does that change your opinion? >> i have great respect for the media. i spent many years as a journalist. we get things wrong. how do we know? can you tell m

she told lindsey graham something totally different. what is going on with this cabinet secretary? >> clearly it doesn't work when you have a bombing at the boston marathon and these people are dead and some injured. the system is designed to prevent something like that from happening. so it would be horrible to say the system worked. if you want to say law enforcement afterwards did a good job, i'm all for that. i think they did a fabulous job in catching the guys as quickly maybe as they could. but before hand, the system did not work. now, is that just because of it's so difficult to follow these things or were there specific things they could have done to prevent it? that's a serious question to be asked. >> brian: to finish up, we know the deputy f.b.i. director told senator graham that they misspelled his name, they had no record he was going over there. therefore, there was neaping. the homeland security -- pinging. napolitano says there was a ping. that bothers me that they're not on the same page. i'm not even judging them. but as a person who is an expert in leadership, w
